These terms apply when you use theotherthing.co.uk or purchase products from us.
ORDERS
By placing an order, you offer to purchase the selected products subject to these terms.
After placing an order, you will receive an order acknowledgement. This does not necessarily mean that your order has been accepted. A contract is formed when we accept your order and send confirmation.
We may decline or cancel an order where a product is unavailable, information or pricing is incorrect, payment is not authorised, fraud is suspected, or we cannot deliver to the supplied address. If payment has already been taken, it will be refunded.
PRODUCTS
We make reasonable efforts to display product descriptions, colours, designs, measurements and images accurately. Colours may appear differently depending on your screen.
Please review the relevant size guide before ordering. Measurements may have reasonable manufacturing tolerances.
Our products are produced to order by a third-party fulfilment partner. Made-to-order production does not remove statutory cancellation rights for standard products. Personalised products may be excluded from change-of-mind cancellation rights.
PRICES AND PAYMENT
Prices are displayed in pounds sterling and include applicable taxes where stated. Delivery charges are displayed before you complete checkout.
Payment must be authorised before an order is processed. Payments are handled by Shopify and the payment providers displayed during checkout.
DELIVERY
Available destinations, delivery charges and current estimates are displayed during checkout.
Our products require production before dispatch. Delivery dates are estimates and cannot be guaranteed unless we expressly agree otherwise.
Please provide a complete and accurate delivery address. Contact us promptly if you notice an error. We cannot guarantee that an address can be changed after production or fulfilment begins.
Unless otherwise agreed, goods will be delivered without undue delay and no later than 30 days after the order is accepted. Please see our Shipping Policy for additional information.
CANCELLATION, RETURNS AND REFUNDS
Your cancellation and return rights are explained in our Return and Refund Policy, which forms part of these terms.
Nothing in these terms limits your statutory rights, including your rights where goods are faulty, damaged, misdescribed or not fit for purpose.
INTELLECTUAL PROPERTY
The Other Thing name, mascot, artwork, product designs, photographs, written content, graphics and website material belong to us or are used with permission.
You may not reproduce, distribute, sell, modify or commercially exploit this material without our written permission.
ACCEPTABLE WEBSITE USE
You must not misuse the website, attempt unauthorised access, introduce malicious software, interfere with its operation or use its content for unlawful purposes.
THIRD-PARTY SERVICES
Our store is hosted by Shopify. We also use third-party payment, fulfilment, analytics and delivery providers to operate the store and complete orders.
Links to third-party websites are provided for convenience. We are not responsible for third-party content or services outside our control.
LIABILITY
We do not exclude liability where doing so would be unlawful, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence.
We are not responsible for losses that were not reasonably foreseeable when the contract was formed. Products purchased as a consumer are supplied for private use, and we are not responsible for business losses.
PRIVACY
Our Privacy Policy explains how personal information is collected, used and shared. By using the website, you acknowledge that your information will be handled as described in that policy.
CHANGES
We may update these terms occasionally. The terms applying to an order are those in effect when the order is placed.
GOVERNING LAW
These terms are governed by the laws of England and Wales. If you live elsewhere in the United Kingdom, you retain any mandatory consumer protections and may be entitled to bring proceedings in your local courts.
